When Must You Report CGT to HMRC?

UK Capital Gains Tax must be reported to HMRC in two ways depending on the type of asset sold. For residential property disposals, you must file a 60-day CGT return and pay tax within 60 days of completion. For all other assets (shares, business assets, commercial property), CGT is reported through your annual self-assessment tax return due by 31 January.

When must I report CGT on a property sale to HMRC?
If you sell or dispose of UK residential property and make a taxable gain, you must file a CGT on UK Property return and pay any tax due within 60 days of completion. This applies even if the gain is covered by Private Residence Relief — you must still file if there is any remaining gain. Missing the 60-day deadline results in automatic penalties starting at 100 GBP plus daily charges.
How do I report CGT on shares and investments?
Capital gains from shares, investment funds, and other non-property assets are reported through your annual self-assessment tax return (due 31 January following the tax year end). You complete the SA108 Capital Gains Summary pages. You must file even if your gains are below the annual exempt amount if your total disposal proceeds exceed 50,000 GBP. What are the penalties for not filing a CGT return on time?
For property CGT (60-day returns): automatic 100 GBP penalty for filing 1 day late, further penalties for delays beyond 6 and 12 months, plus daily charges of 10 GBP for very late returns. For self-assessment CGT: penalties mirror general self-assessment rules — 100 GBP automatic penalty, 10 GBP daily charges after 3 months, and 5% surcharges on unpaid tax after 30 days. HMRC also charges interest on unpaid tax from the due date.
Do I have to report CGT if I made a loss?
You should report losses even if you have no gains, because reported capital losses can be carried forward indefinitely to offset future gains. If total disposals in the tax year exceed 50,000 GBP, you must file the capital gains pages regardless of whether you made a profit or loss. Losses must be reported within 4 years of the tax year of the loss to preserve them.
Can you amend a CGT return after filing?
Yes. Self-assessment returns can be amended up to 12 months after the filing deadline. Property CGT (60-day) returns can also be amended. If you realise you overpaid CGT, an amendment can secure a repayment. HMRC can also open enquiries into past returns within 12 months (or longer if there is a discovery).
